This policy explains how AI Tech collects, uses and protects personal information through the SmartPOSWizard websites and Services.
1. Our role
For our websites, demo requests and customer accounts, the controller is AI Tech, 6232 Camellia Ave, North Hollywood, CA 91606-4119, United States. For Customer Data that a restaurant puts into its Workspace (such as employee, time-clock and guest order information), we act as a service provider or processor for that restaurant, which decides how the data is used.
2. Information we collect
- Contact and demo requests: name, work email, restaurant, phone, number of locations and your message.
- Account information: names, emails, roles, locations and billing contacts.
- Customer Data: menus, orders, order notes and guest names entered at the register, employee profiles, PIN hashes, time punches and audit logs.
- Device and usage data: station enrollment, device heartbeats, IP address, browser type and security logs.
- Ask Babu: the questions you ask our assistant on the website or in the app, its answers, the page you were on, and, in the app, the access choices you make for Babu.
- Billing data: plan, invoices and payment status. Card details are collected by our payment provider, not by us.
3. How we use information
To provide, secure and support the Services; to respond to enquiries and demo requests; to bill for subscriptions; to prevent fraud and abuse; to improve the Services; and to meet legal obligations. We do not sell personal information or use it for targeted advertising.
4. Guest information
Guest-facing screens (pickup boards, kiosks and customer displays) show order numbers and baskets only. Kiosk sessions are cleared between guests. Restaurants control what guest details they enter.
5. How we share information
With service providers that help us run the Services (such as hosting, email and payment processing) under contracts that protect the data; with integrations a restaurant chooses to enable; when required by law; or in a merger or acquisition with notice to you.
6. Ask Babu
Ask Babu runs on our own servers and uses no outside AI service: your questions are not sent to any third-party AI provider. Babu answers from our product documentation and, in the app, from read-only account data the signed-in person is allowed to see. Don’t share card numbers, passwords or other sensitive details with Babu. On the website, Babu knows you only by a random visitor id your browser keeps, not by your identity. Questions and answers are kept so we can improve Babu’s answers.
7. Data retention
Customer Data is kept for the subscription and deleted from active systems within 60 days after it ends (after a 30-day export window). Billing records are kept for as long as tax law requires, typically up to seven years. Contact and demo enquiries are kept for up to 24 months. Ask Babu conversations are kept for up to 30 days.
8. Security
We use encryption in transit and at rest, role-based access, PIN lockout, audit logs and backups. See our Security overview.
9. International transfers
Our services are hosted in the United States, and our team may access data from other countries. Where required, we use appropriate safeguards such as standard contractual clauses.
10. Your rights and choices
You can ask to access, correct, delete or export your personal information, or object to certain uses, by emailing privacy@smartposwizard.com. If your data is in a restaurant’s Workspace, we will refer your request to that restaurant.
11. California privacy rights
California residents may request to know, delete or correct personal information and may not be discriminated against for exercising these rights. We do not sell or share personal information for cross-context behavioral advertising. Email privacy@smartposwizard.com with the subject “California privacy request”.
12. EEA, UK and Swiss rights
If GDPR applies, you also have the right to restrict processing and to complain to your data-protection authority. Our legal bases are contract, legitimate interests, consent (where asked) and legal obligation.
13. Children
The Services are for businesses. We do not knowingly collect personal information from anyone under 16.
14. Changes to this policy
We will post updates here with a new date and notify account owners of material changes.
